The Petition is for leave under Clause XII of the Letters Patent. The Suit is for recovery of an amount under a facility agreement. A material part of the cause of action has arisen in Mumbai where the money was advanced and was repayable. Some of the Respondents are outside Mumbai. With leave granted under Clause XII of the Letters Patent, this Court will have the necessary jurisdiction to entertain and try the suit.
