Heard the learned counsel for the applicant and the learned counsel for the respondent. As per the order dated 29th February 2016, Notice of Motion No.456 of 2016 was made absolute by a Division Bench of this Court while accepting the statement of the applicant that all office objections will be removed within a period of four weeks from that date. The prayer made in this Notice of Motion is for extension of time to comply with the order dated 29th February 2016. Perused the affidavit in support and in particular, averments made in paragraphs 7 to 12 thereof.
In view of what is stated in the affidavit in support, Notice of Motion is made absolute in terms
nma894 of prayer clauses (a) and (b) and time granted to remove all office objections in terms of the order dated 29th February 2016 in Notice of Motion No.456 of 2016 is finally extended by a period of four weeks from today. If compliance is not made within extended period of four weeks, the order of dismissal of the Central Excise Appeal (L) No.157 of 2014 will operate. If compliance is made, the appeal shall be placed for admission on the date fixed as per the C.M.I.S.
