Ms.Phene appearing for the company undertakes to file an affidavit stating that the company has complied with the directions given in paragraph-3 of the order dated 4.5.2018. Ms.Phene states that the advertisement was given in `Free Press Journal' and `Navshakti', both Mumbai edition on 11.5.2018. Ms.Phene and Ms.Anand, counsel appearing for petitioner, and the Deputy Official Liquidator state that they have not received any claim or objections.

2/2 3.CA149.18.doc The company to pay sum of Rs.50,000/- as cost to the Official liquidator and this amount to be paid within one week from today. Ms.Phene appearing for the company undertakes to file an affidavit confirming advertising the petition as stated in this court. Affidavit to be filed and copy served upon the Official Liquidator and others within one week from today.

Petition stands disposed as withdrawn. It is made clear that this order will come into effect only upon affidavit being filed and cost as directed to be paid to the Official liquidator is paid.

At this stage, Mr.Desai appearing for petitioner in disposed PetitionCompany Petition No.551 of 2015 states that the liberty granted in the order dated 2.2.2018 be recalled since they do not wish to pursue the petition. Mr.Desai states that since the company has been keeping up with the installments, if there is any default, Standard Chartered Bank will file a fresh petition on fresh cause of action.
