CORAM: G.S. PATEL, J DATED:

20th June 2016 PC:- 1.

It is difficult to understand the nature of prayers in this Notice of Motion. The first prayer seeks a stay of two ad-interim orders dated 6th November 2009 and 27th November 2009 pending an assessment of certain objections raised by the 2nd Respondent; prayer (ii) seeks a debarring of some Advocates from this Court and every other Court in the country; prayer (iii) seeks action against several Officers of this Court; and prayer (iv) seeks orders against one Shaila Pathak, a Public Notary.

72-NMT41-10.DOC 2.

I am inclined to dismiss this Notice of Motion, and contemplate imposing costs only because of the wording or prayer (iii) which makes the most scurrilous allegations against Judges of this Court, including Mr. Justice S.K. Shah (Retired), Mr. Justice S.A. Bobade (as he then was), Mr. Justice D.G. Karnik (Retired) and Mr. Justice A.S. Oka. The only reason for not imposing costs is that the 2nd Respondent who appears in person is absent today. That absence enures to the 2nd Respondent's benefit at least on the question of costs.

3.

The Notice of Motion is dismissed.
