The learned Counsel for the Petitioner seeks withdrawal of the Petition with liberty to file Public Interest Sharayu.

13-WP-1553-15.doc Litigation in so far as payer clause (a) is concerned and either to file a Suit or an alternate remedy available in law, in respect of prayer clause (b) is concerned.

The Petition is therefore, disposed of as withdrawn with liberty as prayed.

It is made clear that since the Petitioner was bonafidely prosecuting the present Petition, he would be entitled for the benefit of Section 14 of the Limitation Act, 1963 for a period during which the present Petition is pending, in the event of further recourse of alternate remedy.
