IN THE HIGH COURT OF JUDICATURE AT BOMBAY

TESTAMENTARY AND INTESTATE JURISDICTION JUDGE'S ORDER NO. 23 OF 2016 IN TESTAMENTARY PETITION NO. 1615 OF 2014 Meherunnisa Abdul Majid Shaikh ...Deceased And Abdul Rashid Abdul Majid Shaikh & Ors.

...Petitioners

Mr. Tejas Vora, i/b Ms. Kusum Poojary, for the Petitioner. CORAM: G.S. PATEL, J DATED:

11th March 2016 PC:- 1.

The Department seems to have taken an objection in this Judge's Order requiring that the Petitioner should add in the Judge's Order itself that the Petitioner will file a statement of compliance with the terms of the Judge's Order. 2.

Mr. Vora for the Applicants points out that this is unnecessary since the three Petitioners are all Administrators and that there is no minor involved. Further, the three Petitioners are the only heirs. Therefore, a statement of compliance is unnecessary. This would be needlessly repetitive and would only

908-JOT23-16.DOC serve to reiterate that which is already stated in the Judge's Order itself.

3.

I agree with Mr. Vora. The requisition is dispensed with. The Judge's Order is separately signed. Office to number the Judge's Order forthwith.

4.

All concerned to act on an authenticated copy of this order. (G. S. PATEL, J.)
