---- CORAM : K.R.SHRIRAM,J DATE : 18th November, 2015 P.C.:- By an order dated 4th May, 2012, this court was pleased to admit the company petition, directed advertisement in two local newspapers and also directed the petitioners to deposit an amount of Rs.10,000/- with the Prothonotary and Senior Master. The counsel appearing for the petitioners states that they have advertised in two local newspapers viz., Free Press Journal (in English), Navshakti (in Marathi) both Mumbai edition and in the Maharashtra Government Gazette. The counsel further states that they have also filed an affidavit to that effect dated 9th July, 2012 Gauri Gaekwad

20.CA-329-2013 affirmed by one Swamidas Shirshetty, representative of the petitioner. The counsel for the petitioners also confirms having deposited an amount of Rs.10,000/- with the Prothonotary and Senior Master.

The respondents despite notice has not remained present. Since the petition has also been admitted, it will only be appropriate, the reliefs as sought by the applicant in the prayer clauses (a), (b) and (c) are granted.

The application is disposed of in terms of prayer clauses (a), (b) and (c), which reads as under:- "(a) the ad-interim injunction be passed against the respondent company restraining them from alienating, encumbering or creating any third party rights on the registered office and other properties of the respondent company;

(b) the Official Liquidator, High Court, Bombay be appointed as a Liquidator on the book debts and bank accounts of the respondent company;

(c) the Official Liquidator, High Court, Bombay be appointed as a Liquidator on the registered office and other branch offices of the respondent company." (K.R.SHRIRAM,J) Gauri Gaekwad
