This petition seeks review of the order dated 19th November, 2014 by which the writ petition preferred by the review petitioner challenging

Rane * 2/2 * RP-24-2015 Thursday,7.4.2016 the order of reinstatement in service of the respondent with full backwages and continuity of service was dismissed. Mr. Wachasundar, the learned Advocate appearing for the review petitioner states that, the only ground on which review of the order dated 19th November, 2014 sought is discovery of new and fresh material stated at Ground No.4(ii) of the petition. It is stated therein that, the respondent has attained the age of superannuation. This fact, however, finds mention in the correspondence between the parties dated 12th July 2014, 11th August 2014, 21st July 2014 and 19th August, 2014. In that case, the event of superannuation of the respondent was already known to the petitioner prior to the order under review. Hence, the same cannot be discovery of new and fresh material. Thus, there is no case made out for review of the order. The review petition is dismissed.

In view of dismissal of the review petition, the Notice of Motion filed by the review petitioner does not survive. The same is accordingly disposed off.
