The petition was admitted on 13th June, 2001. Subsequently, the petition was stayed since the company had made a reference to BIFR and adjourned sine die.
The counsel for petitioner states that he has no instructions as to whether the company has preferred any application to NCLT because of the repeal of the Sick Industrial Companies Act and all references abating and he also has no instructions from petitioner despite repeated requests seeking instructions. The counsel for petitioner further states that the petition was never advertised though he deposited Rs.2,000/- with the Prothonotary and Senior Master because soon after the admission order was passed, settlement talks began.
