1] Heard learned counsel for the parties.

2] This application is filed under Section 29A of the Arbitration and Conciliation Act, 1996 (for short, "ACA"), whereby the petitioner has prayed for extension of time for the arbitral tribunal to conclude the arbitral proceedings and publish an award.

3] Learned counsel for the petitioner has placed on record an email communication of the learned sole arbitrator, whereby learned arbitrator has recored that final arguments are concluded in the month of January, 2018 and written submissions are also filed on behalf of the parties. As the period of 12 months had expired in December, 2018, the parties were directed to file an application under section 29A of the ACA, seeking an 1/2

11 ARBP 867 OF 2018 extension of the mandate of the arbitral tribunal so that the award can be published.

4] In the above circumstances and having perused the record, it is in the interest of justice that the time to conclude the arbitral proceeding and to publish an award be extended by a period of one month from today. Ordered accordingly.

5] Application is disposed of in above terms. No costs. 6] Learned counsel for the respondent undertakes to file Vakalatnama, within one week from today.
