When the matter was called out none appeared for petitioner. Therefore, the matter was kept back.

Mr. Joshi, counsel for respondent states that he spoke to Mr. Mangesh Patel whose Vakalatnama is on record and Mr. Patel informed him that he is out of Bombay. Mr. Patel then requested him to speak to Mr. Shakti Upadhyay. Mr. Joshi states that he spoke to Mr. Shakti Upadhyay and he told him that he was preoccupied with some other matter. Therefore, petition stands dismissed.

It does not appear whether notice has been published in two newspapers or in the Maharashtra Government Gazette because there is no affidavit on record confirming the same. It is also not clear whether the amount of Rs.10,000/- has been deposited with the Prothonotary and Senior Master pursuant to order dated 24th January, 2017. Gauri Gaekwad
