Further to the order dated 16th February 2018, the official liquidator has submitted OLR No.64 of 2018 in which it is stated that the ex-director has published notice to workers/creditors in Free Press Journal and Navshakti on 27th February 2018 and the last date for filing the claim fixed was 1st March 2018. The official liquidator has reported that his office has not received any claim.
In the circumstances, the petition stands disposed. The official liquidator also stands discharged.
The official liquidator has been holding fort since 2009 and has incurred expenses towards stationery, postage and manpower utilization etc. Substantial amount of time has also been spent obviously by the Shraddha Talekar PS 1/2
2.cp.448.2003.doc official liquidator and his staff. The official liquidator is seeking a direction to direct applicant to pay a sum of Rs. 1 lakh as costs to the official liquidator.
In my view, the official liquidator is justified in seeking and is reasonable too, in seeking costs in the sum of Rs. 1 lakh. Therefore, official liquidator's report No. 64 of 2018 is allowed in terms of prayer clause (a) and accordingly disposed.
The amount of Rs.1 lakh to be paid within four weeks. Upon payment of this amount, official liquidator will stand finally discharged. (K.R. SHRIRAM, J.) Shraddha Talekar PS 2/2
