Learned Counsel for the Respondent tenders Pay Order for a sum of Rs.9,16,706/- which is in full and final payment of a sum of Rs.10,18,762.88/- ( after deduction of TDS ). Learned Counsel submits that though it is the case of the Respondent that no amount is due and payable by the Respondent to the Petitioner, only with a view to buy peace, this payment is tendered to the Petitioner. The Petitioner accepts the payment in full and final settlement of his claim referred to in the Petition and seeks leave to withdraw the Petition. The Petition is dismissed as withdrawn.
