By this Motion, the applicant has prayed for recalling the order dated 2nd May, 2016 passed by this Court [Coram: G.S. Patel, J.] in Petition No. 1832 of 2014. He submitted that applicant has removed all the office objections, save and except following office objection:

Seek necessary direction/orders for publication of citation in Newspaper as whereabouts of the husband of deceased are not known to the petitioner.

Mr. Joshi assures that after restoration of the Petition, he will remove office objection within three weeks from today.

In view of the assurance as also, reasons set out in the affidavit in support of the Motion, I am satisfied that the petitioner has made out case for granting reliefs in terms of prayer clauses (a) and (b). Notice of Motion is made absolute in terms of prayer clauses (a) and (b) with no order as to costs. Petition No. 1832 of 2014 is restored to its original position. Applicant shall remove office objection within three weeks from today. Order accordingly. [R.G. KETKAR, J.]
