I have separately previously granted leave under Clause XII of the Letters Patent. This Petition is for leave under Order II Rule 2 of the Code of Civil Procedure 1908 to omit to sue in respect of the properties left behind by the Plaintiff's ancestors. 2.

The Plaintiff seeks leave to file a separate suit in respect of the ancestral property of the great grand father and the late father of the Plaintiff and the Defendants.
