With consent of the parties heard finally and disposed of at the stage of admission itself.

The grievance of the Petitioner is that an Appeal filed by the Petitioner before the Commissioner of State Excise, Maharashtra is not decided even after lapse of more than a year. The copy of memo of Appeal is filed as Exhibit "H". 4.

A prayer has been made to dispose of this Petition by directing Respondent No. 2 to consider and take appropriate decision on the said Appeal No. 2 of 2017 as expeditiously as possible.

The learned AGP on instruction submits that the Appellate Authority/Respondent No. 2 shall consider and decide the Petitioner's Appeal No. 2 of 2017 within a period of eight weeks. 6.

In view of aforesaid, we dispose of this Petition by directing Respondent No. 2 to decide the Petitioner's Appeal within eight weeks from the date of appearance of the Petitioner before it. 7.

The Petitioner to appear before the appellate authority/ Respondent No. 2 Commissioner on 26th April, 2018 at 11.00 am. 8.
