This notice of motion is taken out, inter alia, to implead the applicant as a party defendant.

The notice of motion was listed before the Court on 7th January, 2020. A submission was made by the learned Counsel for the applicant that the applicant is dead. The learned Counsel had sought time to take instructions as to whether the legal representatives of the deceased applicant desire to prosecute the notice of motion and also to take out the appropriate interim application. Two weeks time was granted. On 4th February, 2020, at the request of the learned Counsel for the applicant further time was granted.

None present for the applicant. As the applicant is reported to be dead, no purpose would be served by keeping the notice of motion alive, which seeks impleadment of the applicant as a party defendant.
