Learned Counsel for the Petitioner submits that the disputes between the parties have been settled and Consent Terms to that end have been filed in a securitisation application pending before the DRT, Mumbai. Learned Counsel seeks to withdraw the petition with liberty to take out a fresh petition in the event the Consent Terms filed in the securitisation application are not implemented.

The petition is dismissed as withdrawn with liberty as prayed. No order as to costs.
