The petitioner seeks six months extension of time to enable the learned arbitrator to make an award. The matter is at the hearing stage before the learned arbitrator.

In view of the judgment of Supreme Court in case of Indus Mobile Distribution Private Limited Vs. Datawind Innovations Private Limited and Ors, (2017) 7 SCC 678, the learned counsel for the respondent does not raise objection in respect of the jurisdiction of this Court to entertain this petition filed under Section 29(A)(4) of the Arbitration and Conciliation Act, 1996.

The learned arbitrator is granted six months time from 27th February, 2018 to make an award. Parties are directed to co-operate with each other and with the learned arbitrator in making an award within the extended period. It is made clear that no further extension would be granted. The petition is disposed of in the aforesaid terms. The petitioner is directed to communicate this order to the learned arbitrator for compliance.
