Upon praecipe, the matters are listed today under the caption "production".

The parties have amicably settled the dispute and have filed "Minutes of Order". "Minutes of the Order" are signed by the Appellant and the Registrar, University of Mumbai for the 1 / 2
APP. 678-05, 386-05 Respondents and their respective advocates.

A was suggestion was given by this Court asking the parties to resolve the dispute. The parties thereafter negotiated with each other and arrived at a final settlement, which forms part of the "Minutes of the Order". It is agreed between the parties that towards full and final settlement of the claim, the Respondents will pay total amount of Rs.50 lakhs to the Appellant in respect of all claims and demands, which are subject matter of the arbitration appeals, viz. Appeal Nos. 678/2005 and 386/2005. In view of final settlement, no claim survives even from the persons who have right to sue after the death of Appellant or his legal heirs, etc. Both the appeals are accordingly disposed of in terms of "Minutes of the Order". 4.
We appreciate the efforts taken by both the counsel, and particularly, the University of Mumbai and we find that they have arrived at just, fair and a reasonable settlement. We also appreciate the efforts taken by the Vice Chancellor and the Finance Committee in these matters. Both the appeals accordingly stand disposed of as withdrawn in the aforesaid terms.
