Earlier the petitioner had approached this Court in Writ Petition No.631 of 2020 which was allowed to be withdrawn with liberty to file a fresh petition, and accordingly, the present petition has been filed, although with some delay.

After this petition was heard for some time, learned Counsel for the petitioner seeks leave to withdraw this petition with liberty to approach the Appellate Authority.

Allowed to be withdrawn with liberty as prayed for. However, as the petitioner is pursing the present proceedings bonafide, let an appeal be filed within three weeks from today and if the same is accordingly filed, it be

1.DOC decided without any objection on the issue of limitation. 4.

Needless to mention that the petitioner would be permitted to seek appropriate documents from the concerned authority, which may be relevant in the adjudication of the appeal which the petitioner proposes to file. If such request is made, let the said documents be furnished by the adjudicating authority to the petitioner within a period of one week from the request so made.

All contentions of the parties are expressly kept open. 6.

Disposed of in the above terms. No costs.
