The Petition is for leave under Clause XII of the Letters Patent. The proposed Suit is for recovery of an amount due under an oral agreement under which the loan was advanced to the 1st Defendant. The 2nd and 4th Defendants are outside Mumbai. A material part of the cause of action has arisen within the jurisdiction of this Court. With leave granted under Clause XII of the Letters Patent, this Court will have the necessary jurisdiction to entertain and try the suit.
