In the order dated 1st February 2019, after paragraph 2 in Notice of Motion No.164 of 2018, the words "notice of motion accordingly stand dismissed" to be corrected to read as "notice of motion accordingly stand disposed". Original order to be corrected accordingly. Mr. Tamboly states that his instructions are not to pursue the suit any more against defendant nos.4 and 5 in view of the order passed on 1st February 2019. Accordingly leave to delete defendant nos. 4 and 5 granted. Cause title to be amended within two weeks from today. As regards Defendant nos.1, 2 and 3, nobody appeared even on Meera Jadhav

2/2 s-652-17(53).doc 8th February 2019. Defendant Nos.1, 2 and 3 have also not filed any written statement. Therefore, suit be transferred to list of undefended suit against remaining defendants, i.e., defendant nos.1, 2 and 3 and placed before the appropriate court.

Mr. Mohanty appearing for defendant no.4 states that notice of motion no.598 of 2018 be considered as withdrawn. The same disposed as withdrawn.

Copy of this order be forwarded to defendant nos.1, 2 and 3 and their advocates.
