On 4th April, 2016 the Counsel for defendant no.2 has stated that he will file reply within one week and the matter stood over to 20th April, 2016. One week expired on 11th April, 2016 and even today the Counsel is seeking further time to file a reply.

I have considered affidavit in support of the Chamber Summons and in my view it is a fit case to allow Chamber Summons in terms of prayer clause (a) and (b). Chamber Summons therefore allowed in terms of prayer clause (a) and (b) and is accordingly disposed.

It is open to the parties to raise all contentions before the Commissioner (K. R. SHRIRAM, J.)
