IN THE HIGH COURT OF JUDICATURE AT BOMBAY

ORDINARY ORIGINAL CIVIL JURISDICTION REVIEW PETITION (L) NO. 15 OF 2017 IN WRIT PETITION (L) NO. 2934 OF 2016

1. Bhamini G. Keni and ors.

.. Petitioners Vs.

1.

State of Maharashtra and ors.

.. Respondents 2.

Mr. Shailendra Kanetkar for petitioners.

Mr. Sukanta Karmakar, AGP for State.

Ms. Pallavi Thakar for MCGM.

Mr. Shailendra Singh for respondent no.4.

CORAM: NARESH H. PATIL & M. S. KARNIK,JJ.

APRIL 27, 2017.

P.C.

1.

It is contended that the Review Petitioners are occupants of the shops situated on the ground floor of the subject building. They had entered into an agreement with the landlord. Both, the landlord and the petitioners-tenants agree that ground floor portion of the building need not

be demolished, while upper portion of the building being dilapidated could be demolished.

2.

The learned counsel for the petitioners submits that the urgency to move the present review petition is that the Corporation has recently disconnected water supply. Even the electricity is disconnected. As the petitioners are running their business, necessary directions be given to re-connect the water supply and electricity connection. Learned counsel appearing for the landlord is in agreement with the submissions of the learned counsel for the review petitioners (shop owners) of the ground floor.

3.

Learned counsel for the Corporation submits that the judgment was pronounced on 10/3/2017 and thereafter consequent steps were taken by the Corporation. Learned counsel opposes the prayer made by the review petitioners.

4.

We have perused the grounds of review. We do not find any justifiable reason and sufficient ground to entertain this review petition. Even on the date of pronouncement of the judgment i.e. on 10/3/2017, no

such request was made to the court.

5.

Review Petition is accordingly dismissed.
