Heard learned counsel for the Petitioner.

A limited grievance was raised in the Petition. It is submitted to this Court that the Petitioner, who was holding position as a VicePrincipal and Head of the Business Economics Department in Respondent No.4 College, was subjected to a dismissal order. Being aggrieved by the said order, the Petitioner filed an appeal in September, 2016. It is

2 8-WP 752-21.odt submitted before this Court that for want of appointment of the Presiding Officer, the appeal could not be heard expeditiously. On the backdrop of this grievance, the Division Bench of this Court, vide order dated 29th September, 2021, expected a response from the State Government in view of the recommendation made by the Hon'ble The Chief Justice in the communication letter dated 7th January, 2020. 3.

The learned AGP today placed on record copy of a decision by the State Government dated 13th October, 2021, same is taken on record and marked 'X' for identification. The State Government, by invoking the powers under Section 80(9) of the Maharashtra Public Universities Act, 2016, is pleased to appoint Shri A.M. Dhavale, former Judge of this Court and his tenure would be three years from the date of his assumption of the charge.

It may not be necessary for us to refer to the other terms in the decision of the State Government dated 13th October, 2021.

In view of the abovereferred decision, we hope and trust that the appeal, filed at the instance of the Petitioner pending before the University and College Tribunal, would be decided as per its turn. 6.
