By the above Interim Application, the Applicant - original Petitioner is seeking following reliefs:- "(a) Delay of one year and 30 days in filing the present Application be condoned;

(b) by an order of this Hon'ble Court, the Order dated 5th December, 2018 passed in Writ Petition No. 346 of 2017, thereby dismissing the Writ Petition for non prosecution be recalled and the said Writ Petition be restored to file to be heard on merits."

Perused the Application. For the reasons stated

5. os ia 1318-20 (30).doc therein, the same is allowed subject to the petitioner paying cost of Rs. One Lakh in charity i.e. in favour of "Tata Memorial Hospital a/c CT/18450". The cheque shall therefore, be issued and handed over to the Associate of this Court. 4.

Learned Advocate for the Petitioner on instructions states that the cheque shall be drawn and as directed hereinabove, deposited within one week from today. The statement is accepted.
