Mr. Sakhardande states that respondent has a problem with the appointment of the Arbitrator recommended by applicant. Mr. Sakhardande suggested four names, one of which is Mr. Rohan Savant. Mr. Roy is agreeable to the appointment of Mr. Rohan Savant as the sole Arbitrator. Accordingly, Mr. Rohan Savant, an Advocate practicing in this Court (Address : 301, 3rd Floor, Rustom Building, Veer Nariman Road, Fort, Mumbai - 400 023, Mobile No.:9833126212, Email ID : rohanranjitsavant @gmail.com) is appointed as sole Arbitrator to arbitrate on all disputes arising out of and/or in connection with and/or relating to the appointment letter dated 24th August 2011 and counter claim, if any. 2/2 10.CARAP-95-2021.doc The fees and expenses of the Arbitrator to be shared equally between the parties and the same will be costs in the arbitral proceedings. Mr. Roy and Mr. Sakhardande state that their respective clients will address a communication, within 24 hours of this order getting uploaded, to the learned Arbitrator confirming their acceptance to his appointment as sole Arbitrator. Statement accepted as undertaking to this Court.
Learned Arbitrator shall make his disclosure in writing under Section 11 (8) read with Section 12 (1) of the Arbitration and Conciliation Act, 1996 directly to the parties.
Liberty to apply in case the learned Arbitrator appointed has any personal difficulty.
Application accordingly stands disposed.
