By this petition filed under Section 34 of the Arbitration and Conciliation Act, 1996, the petitioner has challenged arbitral award dated 18th July, 2019. The petition was filed on 4th November, 2019 with an application seeking condonation of delay of 16 days in filing the petition. 2.

After filing of the petition and the application, the same were not been listed even once before this Court. It was only on specific directions given by this Court to list such matters, filed and kept pending before this Court, that the present petition, alongwith the application, has seen the light of the day.

Even today, when the petition and the application are called out for hearing, there is no appearance on behalf of the applicant/petitioner. It appears that the petitioner is not interested in pursuing the petition.
