P.C. :- After arguing the matter for some time, the learned Counsel for the parties state that the Petition can be disposed of by following order and in view of the fact that the proceedings are pending before the Labour Court, Mumbai, no reasons in support of this order be given as it may affect the merits of rival contentions.

Accordingly, the Writ Petition is disposed of as under :- (i ) The Application filed by the Petitioner below

WP 703.15.sxw Exhibit C-10 will be considered by the Labour Court, Mumbai, before proceeding further with the reference, on its own merits within period of eight weeks from today.

(ii) All contentions of the parties as regard the Application below Exhibit C-10 are kept open. (iii) The impugned order passed by the Labour Court, Mumbai dated 1 January 2015 is modified accordingly.
