Mr. Memon, the Advocate for the applicant submits that his arguing Counsel is not available today. Hence, he requests for sometime. Learned Counsel for the respondents oppose the said request.

Considering the submissions made by the Learned Counsel for the petitioner, the following order is passed :

(i) Office is directed to place this matter on board on 12th October, 2018.

(ii) The applicant to pay costs of Rs.10,000/- to respondent no.5-Society on/or before 10th October, 2018 and place on record receipt to that effect failing which Notice of Motion

3/3 shall stand dismissed without sending back to the Court.

(iii) Stand over to 12th October, 2018.
