Mr. Porus Kaka, learned Senior Counsel appearing on behalf of the petitioners seeks to withdraw this petition. However, he seeks liberty to take out appropriate proceedings to amend the pending writ petition filed by the petitioners being Writ Petition No. 1462 of 2015 to assail the order dated 3rd February, 2014 passed by the Empowered Committee and the Under Secretary of the Ministry of Commerce and Industry. It is his submission that the challenge to the order of the Empowered Committee dated 3rd February, 2014 would have Uday S. Jagtap

1222-16-wp=.doc a continuing impact while assessing the petitioners under the Income Tax Act whenever it claims the benefit of Section 80IA of the Act in respect of its subject Industrial park.

Needless to state, such an application for amendment, if and when taken out by the petitioners, would be considered on its own merits.

The Writ Petition is dismissed as withdrawn with aforesaid liberty.
