This is a petition for winding up of the respondent company, namely, M/s. Accentia Technologies Ltd. On the ground that the respondent company did not pay the admitted debts of the petitioner. The learned counsel for the petitioner submitted that as a matter of record the petitioner had also instituted Summary Suit No. 556 of 2014 in this Court which came to be decreed on 13.09.2016.

In view of the fact that the claim of the petitioner has already been adjudicated and decreed in substantive proceeding i.e. Summary Suit No. 556 of 2014, the present Petition does not survive and is, accordingly, disposed of.
