Heard the learned Advocates appearing for the parties and the following order is passed by consent :

i.

The disputes and differences between the parties relating to or arising out of the tender document / contract relating to the Works of construction of API Bulk Drug Plant carried out by Petitioner No. 1 at the Respondent plot of land at Ambernath is referred to the sole Arbitration of Mr. Snehal Shah, Advocate.

ii. The parties and their Advocates shall appear before the learned Arbitrator in his chambers, on 6th February, 2015 at 5.30 p.m. and obtain necessary directions.

iii. The learned Arbitrator shall endeavour to pass his Award within a

Nitin 1020-ARBAP-283-2014 period of six months from the date of the first meeting held by him with the parties and their Advocates.

iv. The parties undertake not to apply for time on the adjourned date unless absolutely necessary. The learned Arbitrator shall also not grant adjournment to the parties unless absolutely necessary. v. The cost of arbitration shall initially be borne by the parties equally. vi. All contentions of the parties are kept open. vii. The venue of Arbitration shall be at Mumbai. The above Arbitration Application is accordingly disposed of. (S.J. KATHAWALLA, J.)
