Mr.Lad for applicant/petitioner seeks to press the application for appointment of Official Liquidator as provisional liquidator. Admittedly, to the affidavit in reply, is annexed a copy of a letter from Bharat Co-operative Bank Limited in which it is stated that the joint borrowers are the applicant as well as the extrange husband of the applicant and director of respondent company one Hetal M.Parmar. Mr.Lad accepts that the assets of the company are mortgaged to the bank. Therefore the question of company selling mortgaged property does not arise. KJ
