The Notice of Motion seeks restoration of Notice of Motion (L) No. 3630 of 2015. This was rejected on 16th March 2016 apparently for non-removal of office objections. Paragraph 5 of the Affidavit in Support says that the office objections noted on 22nd December 2015 were dealt with by 18th January 2016. The filing order remained to be taken and the Motion thus remained without registration. This is how it came to be dismissed on 16th March 2016.

Having heard to the learned counsel for the parties, I am satisfied that the Notice of Motion deserves to be allowed. It is made absolute in terms of prayer clause (a). Notice of Motion (L) No. 3630 of 2015 is restored to file. It will be numbered in the course of the week and listed as per the CMIS for hearing and final disposal.
