Called out for final hearing. None appears for the petitioner. Perused the affidavit in reply dated 29th January 2007 of Shri R.S.Rawat, working as Major in the office of the Garrison Engineer (Naval Works), Navy Nagar, Colaba, Mumbai. To the said reply a photo copy of the death certificate of the petitioner is annexed.

The petitioner died on 20th November 2005.

It is pointed out in the said reply that the petitioner was granted employment with effect from 10th December 2002 on compassionate ground.

She continued to occupy the service

After her death, the legal representaties of the petitioner have vacated the service quarters.

Hence, nothing survives in this petition and the same is disposed of.

Rule is discharged with no order as to costs.
