The Company Application seeks recall and setting aside of an order dated 2 August 2010. By this order, the Petitioner was directed to comply with Rule 28 of the Companies Court Rules, 1959, within a period of 10 weeks, with a direction that in the event of its failure to do so within 10 weeks, the Petition shall stand dismissed without further notice. The Applicant, who is the original Petitioner, has explained the reasons for its non-compliance in its affidavit in support of the Company Application. Having regard to the reasons, the delay is condoned and the order dated 2 August 2010 is recalled and set aside. The Company Petition is restored to file. The returnable date of the notice under Rule 28 is fixed on 24 August 2015. The Company Application is disposed of accordingly.
