The limited relief sought by the petitioner is direction against respondent no. 2 to decide his departmental appeal filed by the petitioner against imposition of penalty, within a time bound manner.

It is submitted that the appeal has been filed by the petitioner in December 2022. According to the learned advocate for the petitioner, as per the regulations governing the authorities, the appeal has to be decided within 3 (three) months. More than 4 (four) months are over.

Considering the fact that the appeal is pending with respondent no. 2, the respondent no. 2 shall endeavour to decide the appeal on its own merits and in accordance with law, expeditiously, preferably within 4 (four) months. 4.

With the aforesaid direction, the writ petition is disposed of. 5.

No costs.
