Heard the learned counsel for the petitioner. 2.

The petitioner has taken out an Interim Application No. 1896 of 2020 to bring the legal representatives of the petitioner on record. In the application, it is also averred that respondent No. 1 Bina T. Phulwar expired on 17th June, 2018 as a spinster. 3.

This Court while admitting the Contempt Petition No. 82 of 2011 had directed that notice be issued to respondent No. 1 only who committed breach of the order passed by the Court on 20th January, 2009 in Suit No. 1014 of 2009. Notice was not issued to rest of the respondents.

Evidently, respondent No.1 has passed away. No purpose Vishal Parekar, P.A.

26-ia-1896-2020.doc would be served by allowing the applicant to join themselves in the petition as on account of death of respondent No. 1, in the intervening period, against whom alone the notice was issued the petition stands abated.

The applicants are, however, at liberty to work out their remedies against the respondent Nos. 2 and 4, as available in law. 6.

The Contempt Petition No.82 of 2011 stands disposed. 7.
