After some arguments, Mr Mehta for the Plaintif seeks leave to withdraw the suit. The suit is dismissed as withdrawn. There will be no order as to costs.

Mr Mehta with his usual fairness agrees states that the court fees to be refunded will be paid in a donation to the St. Jude India ChildCare Centres, 629, Arun Chambers, 6th Floor, Tardeo Main Road Mumbai - 400 034, Tel: 23515174. He states that the remittance of the Court Fees' refund as a donation may be made directly by the Prothonotary & Senior Master. The statement is accepted.

The Prothonotary & Senior Master will act on production of an authenticated copy of this order. Given what is proposed, and the statement by Mr Mehta on behalf of the Plaintif, the Court Fees paid on the suit are to be refunded in full, and the entire amount, without any deduction, is to be forwarded by the Prothonotary & Senior Master to the St Jude India Child Care Centres, Tardeo, Mumbai. This is to be done within two weeks from today. The court associate will forward a copy of this order to the Prothonotary & Senior Master.
