Mr. Sharma and Mr. Cama state that parties have entered into consent minutes of order dated 6th May 2021, scanned copy of which is emailed to the Court. The print out of the consent minutes of order is taken on record and marked "X" for identification. Mr. Cama and Mr. Sharma state that the original will be filed in the registry within one week from today. Statement accepted. The consent minutes of order is signed by Director of petitioner Mr. Harish Advani and one Mr. Rohan Bhansali, who is Director of respondent and their respective advocates. Both Mr. Sharma and Mr. Cama state that the concerned partners of the firm instructing them identify the signature of their respective clients.

3/4 Order in terms of the consent minutes of order. Accordingly Mr. Rohan Sawant is appointed as Sole Arbitrator to arbitrate on all disputes between the parties arising out of the Business Centre Agreement dated 6th August 2016. Mr. Sharma and

4/4 Mr. Cama state that this would also include counter claim, if any. The Arbitrator to file his disclosure as required under Section 11 (8) read with Section 12 (1) of the Arbitration and Conciliation Act, 1996 directly with the parties through their respective advocates.

The fees and administrative expenses of the Arbitrator including venue charges and typing charges, if any, shall be shared equally between the parties and the same shall be subject to costs in the arbitral proceedings.

The rights and contentions of respondent to raise objections under Section 16 of the Act and the rights of petitioner to press for considering the present petition under Section 9 as an application under Section 17 of the Act are also kept open. Should the parties wish to file any additional pleadings, they may do so. Petition accordingly stands disposed.
