By this application, Applicant is seeking to restore Writ Petition (L) No.3241 of 2019 which stand dismissed in view of conditional order dated 21.01.2020 passed by Protonotary and Senior Master.

The learned Counsel for the Applicant submits that inadvertently, it remained on their part to remove offce objections within time. He submits that Applicant Mohite 1/2

14 osia1935-20.odt undertakes to remove all offce objections within four weeks from today.

Considering the submissions made by the learned Counsel for the Applicant and the averments made in application, we are satisfed that Applicant has made out a case for allowing the Interim Application but at the same time, Applicant has to pay cost of Rs.2,000/-. Hence, following order:

a.

Interim Application is allowed.

b.

Writ Petition (L) No.3241 of 2019 is restored on fle for hearing on its own merits.

c.

Applicant to remove all offce objections in Writ Petition (L) No.3241 of 2019 on or before 30.01.2021, failing which application shall stand dismissed without referring back to the court.

d.

Applicant to pay cost of Rs.2,000/-. Cost to be deposited in the Registry on or before 30.01.2021 failing which Interim Application shall stand dismissed without referring back to the court.

e.
