The deceased have two heirs. The Petitioner is the son. The other heir is the daughter. She has filed her Consent Affidavit. Hence, proclamation dispensed with. The Petition is made returnable forthwith and taken up for hearing and final disposal. 3.
The Petitioner seeks a Legal Heirship Certificate under Section 2 of Bombay Regulation VIII of 1827 in respect of one Kamalini Anant Datar, who is said to have died intestate in Mumbai, where she was ordinarily resident, on 28th October 2008. A copy of her death certificate is annexed. The deceased was survived by a son 3rd April 2018
15-MPTL1019-18.DOC and a married daughter. Their names are mentioned in the tabulation below paragraph 4 of the petition. 4.
The Legal Heirship Certificate is required for submission to the Collector of Mumbai to transfer the premises, Flat No. 002, Ground floor, Amar Bhuvan, Amar Bhuvan Apartment Owners Association Condominium, KSM Haldankar Bridge Marg, Girgaum, Mumbai 400 007, which stood or stand in the joint name of the deceased and Petitioner.

No other Petition for a heirship certificate, succession certificate, probate or letters of administration with or without will annexed has been filed. There is no impediment to the grant of relief.

The petition is made absolute in terms of prayer clause (a) in favour of the persons mentioned in the table below paragraph 4, namely, Dhananjaya Anant Datar and Vijaya Virendra Joshi nee Vijaya Anant Datar.
