The proposed Suit is for recovery of amounts due under a loan agreement. Under it, the 1st Respondent agreed that the courts in Mumbai would have jurisdiction. The loan was disbursed in Mumbai. Part payment was made to the Petitioner in Mumbai. Some of the Respondents are outside the jurisdiction of this Court. A material part of the cause of action having arisen within the jurisdiction of this Court, I am satisfied that with leave granted under Clause XII of the Letters Patent, this Court will have the jurisdiction to entertain and try the suit.
