A scheme has been framed by the BIFR before which the dispute between the parties was pending. The claim of the plaintiff would be governed by the scheme unless it is amended upon challenge.

On the application of the plaintiffs' Advocate on behalf of the plaintiffs the suit is allowed to be withdrawn subject to the right to the plaintiff to challenge the scheme as advised. 3.
