The above Interim Application is fled seeking the amendment to the schedule of the petition as mentioned in paragraph 5 of the Interim Application.
The petitioner had fled the above petition for the Succession Certifcate in respect of certain debts and securities belonging to Anjani Ajitsinh Kapadia, the deceased. The applicant/ petitioner is the son of the deceased. After compliance of the offce objections, this Court was pleased to issue Succession Certifcate in favour of the petitioner on 20th December, 2019. A copy of the Pg 1 of 2
16.ia.1.2020.doc Succession Certifcate is annexed at Exh "A". After grant of the Succession Certifcate, the petitioner observed that in two entries of the schedule, namely, at serial no.4 and serial no.9 there were some typographical mistakes. It is, in these circumstances, that the amendment is sought.
After perusing the Interim Application and hearing the learned advocate appearing on behalf of the applicant/ petitioner, the applicant / petitioner is permitted to amend the schedule of the petition as mentioned in Exh "B" (page 15 of the application) along with consequential amendments, if any. The offce is directed to accept the Succession Certifcate for amending and incorporating the same. The Interim Application is accordingly disposed of. No order as to costs.
