Accepted. Three of the heirs are Petitioners and the fourth heir has consented. Hence, proclamation dispensed with. The Petition is made returnable forthwith and taken up for hearing and final disposal.

The Petitioners seek a Legal Heirship Certificate under Section 2 of Bombay Regulation VIII of 1827 in respect of one Jitendra Kumar Jain, who died intestate at Mumbai, where he was ordinarily resident on 26th July 2017. A copy of the death certificate is annexed.

The Petitioners are the wife and the sons of Jitendra Kumar Jain.

During his life time the deceased lived at Ashok Bhavan, 444, 14th Road, Khar, Mumbai - 400 052.

The deceased survived by three Petitioners and a married daughter Priti Todi. She has consented. The deceased's mother died before him on 22nd February 1987. There are no other legal heirs. 6.
The Legal Heirship Certificate is required for production before the Authorities concerned in respect of various matters pertaining to the estate of the deceased.
7.
No other Petition for an heirship certificate, succession certificate, probate or letters of administration with or without Will annexed has been filed. There is no impediment to the grant of relief.

The Petition is made absolute in terms of prayer clause (a) in favour of all the heirs mentioned in the Petition. 9.
The Certificate will be issued expeditiously.
