This Notice of Motion is taken out by original respondent no.1 employee for liberty to withdraw the amount of Rs.4,79,315/- deposited by the petitioner in this Court pursuant to the interim order

Mr. Cama, learned Advocate appearing for the respondent opposes the application and further submits that respondent no.1 be atleast directed to give some security at the time of withdrawal so that the amount withdrawn by respondent no.1 can be made available to the petitioner in the event, the petitioner succeeds in the petition. In my opinion, respondent no.1 can be allowed to withdraw the amount on he filing an Undertaking in writing, that in the event, the petitioner succeeds in the petition, he will deposit in this Court, the amount with interest, if any as directed, within a period of 8 weeks from the date of disposal of the petition. The Notice of Motion is disposed off in the above terms.
