This Chamber Summons is taken out for impleading applicant as party in the above Petition. Mr. Bhutekar submitted that Testamentary Petition No. 524 of 2003 was dismissed for want of prosecution for not removal of office objections. He, therefore, submitted that in the event of petitioner in Testamentary Petition No. 524 of 2003 taking out proceedings for restoration, he may be directed to give advance notice to the applicant herein.

In view thereof, Chamber Summons is disposed of reserving liberty to the applicant to take out appropriate proceedings in the event, petitioner in Testamentary Petition No. 524 of 2003 applying for restoration. The petitioner shall give advance notice of two weeks before applying for revival of the main Petition.
